Non-Refundable Reservation Policy
Pursuant to the principle of freedom to contract under Article 1306 of the Civil Code of the Philippines, this reservation is covered by a strictly non-refundable policy. Once payment has been made to confirm the reservation, no refunds shall be issued under any circumstance, including but not limited to cancellations, no-shows, or modifications initiated by the guest.
This policy ensures operational readiness, resource allocation, and fairness to all our guests.
Cancellation Due to Fortuitous Events
Under Article 1174 of the Civil Code, a party is not liable for failure to perform obligations due to a fortuitous event, defined as one which could not be foreseen or, if foreseen, could not be avoided (e.g., natural disasters, government lockdowns, or calamities).
To qualify for consideration under this exemption:
Notify us in writing within 48 hours from the occurrence of the event.
Submit supporting documents (e.g., medical certificate, travel advisory, police report) within 7 calendar days.
If approved, a one-time rebooking may be granted.
No refunds - whether full or partial - will be issued under this provision.
Please note: Mechanical vehicle failure alone is not considered a fortuitous event under Philippine jurisprudence. Guests are advised to ensure their travel and vehicle arrangements are in proper condition.
Host- Initiated Cancellations
In the rare event that the host cancels your booking due to unforeseen circumstances such as: sudden maintenance or structural concerns, utility disruptions beyond control, force majeure events. We shall offer you:
• A full refund, or
• Alternative accommodations of equivalent value (subject to availability and guest consent)
This complies with the principle of good faith in contracts (Article 19 and Article 1159, Civil Code).
Acknowledgment and Agreement
By confirming your reservation and submitting payment, you agree to the Terms and Conditions of Stay provided after booking.
Even if the down payment was made beforehand, continued reservation without objection constitutes implied acceptance, in line with the Civil Code (Articles 1306 and 1159).
It is assumed that travel plans are final upon payment. As a rule, the non-refundable policy applies, and any exceptions are at the host's discretion, based on just cause and documentation.
Non-compliance may result in penalties, forfeiture of payment, cancellation of stay, or legal liability.
